Question 1
Craig is a successful civil engineer who has made a fortune through property development by taking advantage of the tremendous growth of the property market in recent years. He is known for building spacious, high end, luxury mansions favoured by his rich and famous clienteles.
Two weekends ago, Craig saw a large block of land adjacent to the local park known as “Green Acre” for sale and it immediately attracted his attention as it was the final block of vacant land remaining in his prestigious suburb.
Before Craig signed the contract to purchase the land, he went to the local council to inquire whether there was any restriction on the land and in particular if there was any plan to widen the road abutting the block. The Council staff however was distracted by his mobile phone whilst checking the property information on the computer system and told Craig there was no plan to widen the road, grossly overlooked Council’s imminent proposal to acquire half of the said vacant block for the purpose of road widening.
Craig then learns the news after signing the contract and is now facing substantial losses as he is no longer be able to build large spacious houses like he had planned given he will now lose half of the land to new roads.
Advise if Craig is able to sue the Council for damages
