HOW DO WE EVEN STUDY GUYS!?
There will 5 be cases that we need to write briefs for. However, there is a difference in that we need to do it:
-
in IRAC format (issue, rule of law, application, conclusion aka opinion),
-
we only know the facts, and
-
we need to create our own opinions on them as if we are the judge in the case.
The best way to study would probably be to know all the cases we went over in class and to know the laws (these can be court cases, civil codes, etc) and how to apply them in detail. The grading will go as follows:
5 Questions. Each question is 10 points (50 total):
-
3 points for addressing issue
-
3 points for identifying rules to address issues
-
4 points for applying these to the facts
. I heard we need to know stuff about agencies and breach of contract- what else??
-
Statute of fraud (most of the stuff i listed earlier just fell under this umbrella so know the aspects well)
-
Liabilities (agents, independent contractors)
-
Mistakes
-
Remedies
