You are the Vice-President of Customer Service.
You are watching the 11 pm news one evening when you see, Sheila, your Manager of Call Center Operations appear on television. She is wearing the uniform of a member of the KKK (Klu Klux Klan). She is being interviewed on television about her involvement with the Klu Klux Klan. Sheila talks about the activities of the KKK.
She even tells the interviewer that she is a “Manager” but does not mention the Company name. However, she states that in her opinion her “Company” is becoming “wicked” because they are hiring too many “non-whites” and people of “Jewish” heritage.
You are scheduled to give Sheila her performance appraisal the following morning at 9 am. She is scheduled to get a substantial raise and an overall rating of “exceptional”.

Week 4 DQ2

A Senior Manager is abusive, rude and hostile to virtually every member of his department. He tells crude jokes. He tells them to any member of his department that will listen. He gives meager raises to his entire department. He yells at men and women equally.
 He burps and passes gas in the presence of his employees. He smells horrible and complains loudly about how virtually every member of his department is performing horribly.
 He recommends not a single employee for promotion in his department. He is universally hated and loathed by his employees, many of whom have resigned in disgust.
 This manager is grossly overweight, unkempt and unpleasant to look at. Despite this he complains about the physical appearance of all of his employees. Human Resources refuses to take any action and says that there is nothing that the Senior Manager is doing that is illegal or discriminatory.
Please respond to the following questions:
 1) Is the Manager’s conduct discriminatory or illegal? Is Human Resources correct?
2) Have you ever experienced this type of employee in the workplace? Did your Company take any action?
3) Can the Company take any action against this Manager?
4) If yes, what can the Company do?

Consider that current statistics show that women are more than half of the current workforce; female employees earn 77 cents for every dollar male employees earn; and women receive more college degrees than men.  Do the conclusions in the Gender Wage Gap video conflict with current statistics?  As a manager, how would you mitigate and reduce the risk associated with potential claims of gender discrimination in the workplace?

The people who live in Mayberry, South Carolina voted unanimously to support a town ordinance that prevents anyone over the age of 55 from working a night shift.  Karen Kasey, physics honor graduate from Mayberry Junior College, recently lost her husband.  She was lonely being home all the time, and all five of her children are either attending school away from home or they have jobs in other states.  When Karen saw that Tennaco Discount Department Store would be hiring night workers to stock the shelves in the food department, she applied for and was hired for the job.  After Tennaco hired Karen, the male employees constantly made derogatory comments about her so she could hear them, expelled gas in her presence and hung pictures of nude women in the employee break room.  Karen complained to her supervisors about the way she was being treated, but they ignored her complaints.   Karen asked to have the third Monday off from work every other month so she could celebrate her religious rituals of riding in the moonlight, a major holiday in the Night Riders religion.  Management told her she was too valuable an employee and she had to work every Monday every month. 

Jimmy Kelipso wanted the job that Karen was hired to do, and filed a discrimination complaint in Mayberry District Court to get the job.  He stated he was stronger than Karen,  had a high school education and met the minimum requirements for the job.  In addition, Jimmy sued Tenneco for violating the town statute that said people over 55 could not work at night.  Jimmy is 28 and Karen is 57.  Karen quit her job after the lawsuit was filed.  Describe at least two legal problems that Tenneco faces in this case.  How would you resolve the issues you identified if you were the supervising night manager at Tennaco?  Remember your class readings and utilize information from your readings in your response
